File for Bankruptcy and be Judgment Proof

It’s very common to have creditors get a judgment against you before your bankruptcy cases even filed. That judgment is the race by the bankruptcy filing, unless it’s a type of debt that isn’t discharged anyway. Such as fraud and theft intentional injury and so on. This doesn’t automatically mean that you need to file for bankruptcy. You may be judgment proof, where you have no unprotected income or assets for a judgment creditor to take. You can put off for filing until you absolutely need it. The worst that will happen is the judge might call you every six months or so to see if your situation has changed which justifies the payment order. Any payment order will go away in the later bankruptcy filing.
